Disability status and the Schwerbehindertenausweis
Grad der Behinderung

On this page
If a disability affects your daily life, you can apply for an official assessment. The decision recognises how the disability affects your participation in society. Apply to the responsible authority in your Land; a diagnosis alone does not automatically give you a disability ID or a pension.
In short
- SGB IX section 2 concerns impairments which, together with barriers, are likely to restrict equal participation for longer than six months.
- Schwerbehinderung normally requires a GdB of at least 50 and lawful residence, ordinary stay or qualifying employment in Germany. GdB is a degree, not a percentage of inability to work.
- At GdB 30 or 40, you may seek Gleichstellung through the Agentur für Arbeit if the disability prevents obtaining or keeping a suitable job. This workplace status is not a GdB 50 ID.
Find the authority and prepare the application
- Search your Land’s official service portal for “Behinderung feststellen” or “Schwerbehindertenausweis” and select your municipality. The authority may be called Versorgungsamt or a different name; use its own form and submission channel. The linked Berlin service is a local example; use the authority responsible for your own address.
- List your lasting limitations, treating doctors and hospitals, treatment dates and any existing assessments. Gather recent specialist reports that explain how you are affected. Describe the difficulties you experience in daily life as well as your diagnoses.
- Follow the form’s identity, residence and medical-consent requirements. Supply copies of relevant reports and keep the complete application and receipt. Ask the authority about missing reports, accessible communication or help completing its form. Do not pay a commercial website merely to locate a public form.
Read GdB and Merkzeichen separately
Section 152 provides recognition from GdB 20, in steps of ten. Multiple impairments are assessed together with their interaction; adding individual figures yourself does not determine the overall GdB. The decision also considers requested qualifying health markers, Merkzeichen. At GdB 50 or above, request the Schwerbehindertenausweis as the authority instructs, including a photograph where required. Check the recognised start, markers, validity and any review date.
Use the decision to ask the relevant office or employer what support you qualify for. Transport concessions, tax measures and workplace protections each have their own conditions; the ID does not make every journey free. For workplace problems, ask the Schwerbehindertenvertretung if there is one, the works council or the responsible Integrationsamt/Inklusionsamt. At GdB 30 or 40, ask the Agentur für Arbeit about a separate Gleichstellung application and evidence of employment difficulties.
If the decision is incomplete or your condition changes
Keep the decision and envelope, and note when you received them. A domestic social-law Widerspruch (objection) is ordinarily due within one month of notification under SGG section 84; notification abroad has a three-month rule. Follow the instructions on the decision and use an accepted filing channel. Keep proof of receipt and ask for the assessment basis so you can explain any limitations that were missed. An ordinary email is not automatically a valid objection. If the effects of your condition change, ask about reassessment; the authority reviews the overall status and may also lower it.
