Official letters and deadlines

Bescheid

On this page

A Bescheid is an authority’s written decision. Check whether it tells you how to challenge the decision and whether those instructions are correct. The procedure determines the deadline and what happens if the instructions are missing or wrong.

In short

  • On the day a Bescheid arrives, check whether it includes a correct remedy notice and record the date you actually received it. A deadline can run whether or not you have translated the letter.
  • Sections 58, 70, and 74 apply to proceedings under the Code of Administrative Court Procedure, such as many residence and registration decisions. Do not apply them to a private contract, a landlord’s letter, or an invoice.
  • For social benefits from a Jobcenter, the Agentur für Arbeit, or a health or pension fund, section 84 of the Social Court Act requires a written, electronic, or recorded Widerspruch within one month of notification in Germany, or three months if notified abroad. Section 87 gives one month for a social-court action if the decision was notified in Germany, or three months if it was notified abroad. If a preliminary procedure took place, that period runs from the objection decision; otherwise it runs from the original decision. If the remedy instruction is missing or incorrect, section 66 allows the remedy only within one year, unless filing inside that year was impossible because of force majeure or you were told that no remedy exists.
  • For a tax assessment from the Finanzamt, section 355 of the Fiscal Code requires an Einspruch within one month of notification. If the instruction is missing or incorrect, section 356 allows the Einspruch only within one year of notification, unless filing inside that year was impossible because of force majeure or you were told that no Einspruch exists.
  • Where Land law excludes the preliminary Widerspruch, the one-month court action under section 74 runs directly from the decision notice.
  • When the remedy notice is in place, a Widerspruch under section 70 is due one month after notification, and it must arrive within that month. Posting it before the deadline is not enough if it arrives late. File it with the issuing authority or the authority that will decide the objection, in a form section 70 accepts.
  • If the notice is missing or wrong, section 58 allows the remedy only within one year of service, opening, or pronouncement, unless filing inside that year was impossible because of force majeure or you were told that no remedy exists. That year is not a grace period on top of a correct one-month notice.

What you need to know

The sections explained below concern proceedings under the Code of Administrative Court Procedure, for example many residence and registration decisions. Tax assessments and decisions within social-court jurisdiction have separate deadlines, explained below. Do not apply sections 58, 70 and 74 to a private contract, a landlord’s letter or an invoice. The letter usually ends with a Rechtsbehelfsbelehrung: instructions naming the remedy, the authority or court where it must be filed, that body’s location and the deadline.

Section 58 says the period for a remedy starts only if you have been instructed in writing or electronically about the remedy, about where to file it, about the seat, and about the deadline. If the instruction was omitted or is incorrect, the remedy is admissible only within one year of service, opening, or pronouncement, unless filing inside that year was impossible because of force majeure, or you were told that no remedy exists.

If the decision includes correct instructions for challenging it, section 70 generally gives you one month from notification to file a Widerspruch (objection). You can file it in writing; electronically with a qualified electronic signature under section 3a(2) of the Administrative Procedure Act; through a channel that replaces writing under section 3a(3) of that Act or section 9a(5) of the Online Access Act; or by making a statement for the record at the issuing authority.

Replacement channels include qualifying official online forms with the required identity checks and specified secure electronic mailboxes; an ordinary unsigned email is not enough. Follow the filing instructions in your letter. Filing with the authority that will decide the objection also meets the deadline.

Section 74 then gives one month to bring an action for annulment after the objection decision is served. If no objection decision is required, the action is due within one month of notification of the original act.

Section 68 is the reason a preliminary Widerspruch can be absent: no preliminary procedure is required where a statute so provides. Where Land law excludes that preliminary Widerspruch, the one-month court action under section 74 runs directly from notification of the decision.

Not every letter is a Bescheid, and not every decision uses the objection route. The instruction on your letter is the first place to look. A private contract, a landlord’s letter, or an invoice is not this procedure.

Decisions on jobseeker support, unemployment benefit, statutory health insurance or statutory pensions generally follow the Social Court Act. Not every social benefit does: BAföG disputes use the administrative courts under section 54 of BAföG. Follow the decision’s remedy notice.

Section 84 requires a Widerspruch within one month after the decision was notified, in writing, in an electronic form that section accepts, or recorded at the body that issued it. If the decision was notified abroad, that period is three months.

Section 87 gives one month to bring the social-court action. If a preliminary procedure took place, that month runs from notification of the objection decision; otherwise it runs from notification of the original decision. Notified abroad, the action period is three months.

If the remedy instruction is missing or incorrect, section 66 allows the remedy only within one year of service, opening, or pronouncement, unless filing inside that year was impossible because of force majeure or you were told that no remedy exists. That year is not a grace period on top of a correct one-month notice.

A tax assessment from the Finanzamt uses an Einspruch under the Fiscal Code, not the administrative-court Widerspruch. Section 355 requires the Einspruch within one month of notification. If the instruction is missing or incorrect, section 356 allows it only within one year of notification, unless filing inside that year was impossible because of force majeure or you were told that no Einspruch exists.

What to do

  1. Read the last part of the letter on the day you receive it. Record the actual receipt or electronic-notification date and keep the letter and envelope, including any formal delivery note. The notification rules can affect when the period starts. Record the remedy, filing address, and deadline.
  2. For a Widerspruch governed by section 70, ensure it reaches the issuing authority or the authority deciding the objection within the deadline, in an accepted form. Posting it before the deadline is not enough if it arrives late. Keep a copy and proof of receipt; follow the notice’s filing instructions.
  3. If the instructions are missing or wrong, section 58 sets a one-year outer limit instead. That is not a reason to wait, and a late filing can still be refused if you were correctly instructed.
  4. Check which procedure governs the decision. For a social-benefit decision governed by the Social Court Act, use the one-month Widerspruch in section 84 of the Social Court Act and the one-month social-court action in section 87 (three months for each if notified abroad), or the one-year limit in section 66 if the instruction is missing or wrong. For a Finanzamt tax assessment, use the one-month Einspruch in section 355 of the Fiscal Code, or the one-year limit in section 356 if the instruction is missing or wrong. Where Land law excludes the preliminary Widerspruch, the one-month action under section 74 runs from the decision notice. Do not copy the administrative-court sections onto a private contract, a landlord’s letter, or an invoice. Get help promptly if the notice is unclear or seems wrong.

Court payment orders use another procedure

A Mahnbescheid is not the administrative decision described above. The court does not initially examine whether the debt is justified. Section 692 of the Code of Civil Procedure requires a domestic payment order to give two weeks from service in which to object. If you dispute it, make sure your objection reaches the issuing court within those two weeks. A Vollstreckungsbescheid has a separate urgent remedy and can be enforced. Keep the service envelope and use the related Debt collection guide immediately. An objection sent only to the collector does not respond to the court.

File-sharing software can upload protected films, music or games while downloading. Use lawful sources and understand the sharing function before using such software. A copyright Abmahnung can be a genuine legal warning, not an authority decision or automatically a scam. Preserve the letter, envelope and deadline and obtain prompt specialist advice. Do not ignore it, pay blindly, or sign an unchecked admission or cease-and-desist undertaking: it can create continuing obligations. Asking for advice does not itself extend the stated deadline. If you need more time, request an extension and obtain confirmation.

Help understanding a letter

Free and confidential migration advice can help eligible newcomers understand letters and find the appropriate service. Ask the local service about eligibility and languages; younger people can ask about the youth migration service. Consumer advice handles contract disputes but individual advice can be charged. Court deadlines or a contested legal claim may require a lawyer rather than general counselling. Take the full letter, envelope, related documents and dates. Waiting for a counselling appointment does not preserve a deadline.

Choose the service and find it locally

Problem Appropriate starting point
Understanding a letter or accessing integration services MBE for adults or JMD for young people; check the service’s target group, eligibility and languages
A contested right or court response A lawyer in the relevant field; check legal aid before agreeing fees
Debts beyond your budget or account attachment Recognised debt/insolvency advice, disclosing urgent deadlines

Use the official BAMF-NAvI counselling finder, selecting the service type, postcode/town and search radius. BAMF explains that it covers federally funded services and some Land programmes, not every possible service. Call before attending to confirm booking, eligibility, language and help with your particular document; not every centre offers every language or legal representation. If the counsellor is only helping you understand the letter, establish who will file the legally effective response in time.

Common mistakes

  • Counting the month from the date printed on the letter rather than from notification, when the instruction and section 70 start the month at notification.
  • Filing at a different city’s office because a forum said any Bürgeramt will do. The instruction names the authority.
  • Ignoring the letter because it is in German. The deadline runs whether or not you have translated it. Ask for help immediately, and file on time.
