Legal-expenses insurance
Rechtsschutzversicherung

On this page
Legal-expenses insurance (Rechtsschutzversicherung) can pay legal costs within the cover you agree with the insurer. It is voluntary. A policy does not extend the deadline on an official decision, and liability insurance has a different role when someone claims damages against you.
In short
- Section 125 requires the insurer to provide the benefits needed to look after the legal interests of the policyholder or the insured person, in the scope the contract agrees. BaFin states that this typically means statutory lawyer fees, court costs, compensation for witnesses and experts, and the other side’s costs when you have to pay them. Out-of-court fees and mediation are often included. The contract decides which of those it actually pays.
- The policies are not standardised. BaFin names examples such as tenancy, employment, traffic, and private contracts. A loss is covered only if that area is in the contract.
- BaFin describes ordinary cover as being for future disputes. A cause arising before insurance begins or during an applicable waiting period is generally excluded. A waiting period is often three months and can be shorter or longer. Some specialist offers describe limited help with an existing dispute under their own conditions; do not assume your case qualifies. BaFin states that some events have no waiting period, including being the victim of a traffic accident or of a crime. BaFin lists serious criminal offences (Verbrechen) and disputes about gambling or betting contracts among examples of exclusions. Criminal-defence and victim-related cover depend on the insured module, the allegation and the contract; ask the insurer about your case.
- Liability insurance includes defending an unfounded damages claim against you. A club, tenant association or union may already offer legal advice, so check what you have before taking out another policy.
What you need to know
Section 125 ties the insurer’s duty to the agreed scope. Before signing, BaFin suggests considering which areas of life you want covered and whether you expect disputes involving large amounts. It also advises checking whether another arrangement already covers some of the risk: a motoring club, tenant association or union may include advice. If someone makes an unfounded damages claim against you, your liability insurer conducts the defence and bears the costs; do not assume a legal-expenses policy does the same.
Section 2 of the Insurance Contract Act permits a contract to agree that cover begins before the contract is concluded; its second paragraph also addresses the policyholder’s knowledge that an insured event has already occurred. ARAG describes one commercial offer for help with certain existing tenancy disputes, subject to its own conditions and exclusions; this is an example, not a recommendation or a statement about other insurers.
Ordinary future-dispute cover should not be confused with a specialist offer. A contract’s definition of the insured event, eligibility rules, limits and cost matter, and retroactive cover is not automatic.
Section 127 gives you the right to choose the lawyer who will represent you in court and administrative proceedings, from the lawyers whose fees the contract pays. The same choice applies when you use the policy for other legal interests. The choice is not a right to any lawyer regardless of the contract.
If the insurer refuses because the case has insufficient prospect of success or the pursuit would be wanton, section 128 requires the contract to provide an expert procedure, or another procedure with comparable guarantees of impartiality, to decide that disagreement. The insurer must point you to it when it refuses.
If the contract has no such procedure, or the insurer does not point it out, your need for legal protection in that case is deemed accepted. Section 129 says sections 126 to 128 cannot be altered to your disadvantage.
BaFin says that when the insurer accepts a claim, it pays the costs directly, so you do not have to advance them. Section 128 addresses a refusal for lack of prospects. The insured sum, excess and family members covered depend on the contract. BaFin says partners and minor children are often included, but check your own policy schedule.
Public help with legal costs is a different route. The Justiz-Services portal explains out-of-court Beratungshilfe and the separate court process-cost aid. The tenant page says where a Land uses another public advice service, and that taking documents to an adviser does not itself stop a notice or a court deadline. Neither that aid nor this policy replaces the remedy period on an official decision. The official-letters page explains that deadline.
What to do
- Write down the dispute you are worried about and whether it has already started. Ordinary new policies generally exclude an existing cause. Before relying on a specialist offer, ask the insurer in writing whether your disclosed case is covered and on what terms.
- Read which areas the offer includes, the sum, the excess, the waiting period, and who is insured. Do not treat a package labelled “private” as cover for work, tenancy, or traffic unless the schedule says so.
- If a damages claim is made against you, tell the liability insurer in the way the liability page describes. Do not assume a legal-expenses policy is the defence to that claim.
- If you receive a Bescheid, use the deadline on that letter. Buying or claiming on this policy does not move it.
- Keep the schedule, the insurer’s decision, and the lawyer’s invoices. If the insurer refuses for lack of prospect or because it calls the case wanton, ask for the procedure section 128 requires.
Common mistakes
- Expecting an ordinary policy to pay for a case that had already arisen or arose during the applicable waiting period. Check any specialist offer’s actual conditions instead of assuming it covers your case.
- Using it as a substitute for liability insurance. One funds agreed legal costs. The other defends and pays damages claims against you, within its own contract.
- Assuming you may instruct any lawyer. Section 127 is a choice among lawyers whose fees the contract covers.
- Missing the deadline on a Bescheid while waiting for a policy decision or an advice appointment. The official-letters guide explains the remedy period.
